NavIQ, LLC ("NavIQ, ” “Controller, ” "we, " "our, " or "us") is committed to respecting your privacy.   • any third party, including through any application or content (including advertising) that may link to or be accessible from the Platform or pages on social media platforms.

We may collect personal information that you submit when you contact our customer service team or your account representative.

This may include a unique personal identifier, online identifier, IP address and location based on IP address, device identifier, browsing history, search history and information regarding interaction with an Internet website, application or advertisement. This may also include information about the browser you are using or what site you came from and what site you visit when you leave us. We may also collect information about how you interact with an advertisement.

Retention Criteria for Personal Information

We consider, on a case-by-case basis, a number of factors to assess how long personal information is retained. These factors include what personal information is reasonably necessary to

Anonymized Aggregated Data

We collect and use conversational data generated by you in connection with your interactions with the Platform. All such data is aggregated and anonymized. We sell such anonymized, aggregated data to third parties.

Sensitive Data

As a result of your use of the Platform, we may obtain “sensitive data, ” which includes personal data revealing racial or ethnic origin, religious beliefs, mental or physical health condition or diagnosis, sex life, sexual orientation or citizenship or immigration status. We store such data, if any, solely to provide our services to you. We do not sell or share this information.

Information Protected by the Family Educational Rights and Privacy Act (“FERPA”).

As a result of your use of the Platform, we may obtain educational record information protected by FERPA. We store such data, if any, solely to provide our services to you. We do not sell or share this information. We comply with all requirements of FERPA with respect to the handling of this information.

Your Privacy Rights

You have the rights listed below with respect to the personal information that we maintain about you. We may take steps to verify your identity, as permitted or required under applicable law, before we process your request. Verification may include asking you to provide information about yourself that we can match against information already in our possession.
  • Notice. You can request that we disclose what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling or sharing personal information, the identities of third parties to whom we have disclosed personal information, and the specific pieces of personal information we have collected about the consumer.
  • Deletion. You can request that we delete personal information about you which we have collected from you.
  • Correction. You can request that we correct inaccurate personal information that we maintain about you.
  • Opt Out of Sale of Personal Information. You have the right to opt out of the “sale” of your personal information. You may submit an opt-out request at this link.

  • Right to Non-Discrimination. We are prohibited from discriminating against you if you exercise your rights under applicable law.
  • Portability. You have the right to obtain data that we have collected about you up to twice a year. Data will be provided in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.

If we deny your rights request and you would like to appeal, you may contact us at privacy@naviq.tech. Please indicate that you are making a “Privacy Rights Appeal” request. Agents that you have authorized to act on your behalf may also submit privacy requests as instructed above. The agent must also provide evidence that it has your written permission to submit a request on your behalf. If we are unable to verify the authenticity of a request, we may ask you for more information or may deny the request.
Please note that we do not knowingly collect, sell or share the personal information of consumers under 16 years.

Where technically feasible, we honor web browser Do Not Track (“DNT”) signals.

State-Specific Privacy Rights

The law in some states may provide you with additional rights regarding our use of personal information. These rights are described in the state addendum attached at the end of this policy.

Data Security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. We use encryption technology for information sent and received by us.

The safety and security of your information also depends on you. Where you have chosen a password for the use of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to the Platform. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in our Platform or in your operating system.

Third Party Sites

Our Platform may contain links to third party websites or services that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other websites or services. The privacy practices of these third parties, including details on the information they may collect about you, are subject to the privacy policies of these parties, which we suggest you review.

Children Under the Age of 13

The services made available online via the Platform are generally not directed at nor intended for use by minors. We do not knowingly collect information from minors under the age of 13. If you are under 13, please do not use or provide any information to us online via webpages or through the Platform, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received information from a minor under 13 without verification of parental consent, we will delete that information. Changes to our privacy policy

We may change this Privacy Policy at any time. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users' personal data, we will notify you by email to the email address we have on file for you. Privacy Addendum for California Residents

This California Privacy Addendum (the "California Addendum") supplements the information contained in the Privacy Policy and applies solely to all users, customers and others who reside in the State of California ("consumers" or "you"). We adopt this California Addendum to comply with the California Consumer Privacy Act of 2018 and its implementing regulations, as they may be amended or superseded from time to time (the "CCPA"), and any terms defined in the CCPA have the same meaning when used in this California Addendum.

1. Collection of Personal Information

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information"). The type of personal information we collect may vary depending on your relationship with us. For this reason, we may collect, and over the prior 12 months have collected, the following categories of personal information from consumers:

  3. Characteristics of protected classifications under California or federal law, such as age and sex.
  4. Commercial information, such as details of transactions, purchases, or other transactions with us.
  5. Geolocation data, such as your real-time location (if you have opted-in to sharing your location through the website).

    Personal information does not include publicly available information from government records, deidentified or aggregated consumer information, or other information as set forth under the CCPA.

Access to Specific Information and Data Portability Rights

Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf (an "Authorized Agent"), may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. We are not obligated to provide information to you in response to your verifiable consumer request for access or portability more than twice in a 12-month period.
The verifiable consumer request must:
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an Authorized Agent.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We are unable to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. With few exceptions, we will only review and fulfill a request from your Authorized
Agent if (i) you grant the Authorized Agent written permission to make a request on your behalf, (ii) you or the Authorized Agent provides us notice of that written permission, and (iii) we are able to verify your identity in connection with that notice and the request. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Verifying Your Identity

Before completing your request to exercise the below, we will verify that the request came from you by comparing the identifying information provided by you in your request with any personal information we maintain about you at that time. For all requests, we will need the consumer's

  1. name,
  2. email address, and
  3. telephone number.
To protect the privacy and security of your personal information, we may request additional information from you to help us verify your identity and process your request. This information may include your driver's license or other government-issued identification number. We may also contact you to ask you for further information in relation to your request to speed up our response. You may also be asked to complete and provide a signed declaration under penalty of perjury that you are the consumer who is the subject of the request in certain circumstances. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

6. Non Descrimination

You have a right not to receive discriminatory treatment by us for exercising your rights under the CCPA. Unless permitted by the CCPA:
  • You will not be denied goods or services.
  • You will not be charged different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • You will not be provided a different level or quality of goods or services.
  • You will not receive suggestions that you could obtain a different price or rate for goods or services or a different level or quality of goods or services.

7. Changes to our California Addendum

We reserve the right to amend this California Addendum from time to time. When we make changes to this California Addendum, we will post the revised California Addendum on this page with a new "Last Updated" date.
